Privacy Policy

This Privacy Policy ("Policy") explains how Archer Futura Technologies AB, a company incorporated under the laws of Sweden, with its registered office in Stockholm, Sweden ("Company", "we", "us", or "our"), collects, uses, shares, and protects personal data in connection with our platforms, websites, and services (collectively, the "Service").

This Policy applies to all users of the Service worldwide. By accessing or using the Service, you acknowledge that you have read and understood this Policy. If you do not agree with our data practices, you should not use the Service.

This Policy should be read together with our Terms of Service.

1. Data Controller

1.1 For personal data processed in connection with your use of the Service, the data controller is Archer Futura Technologies AB, Stockholm, Sweden.

1.3 Where we process personal data on your behalf (for example, personal data contained in Content you upload to the Service), you are the data controller and we act as data processor in accordance with a Data Processing Agreement ("DPA") available upon request.

2. Personal Data We Collect

2.1 We collect the following categories of personal data:

2.2 Account and Registration Data. When you create an Account, we collect your name, email address, password (stored in hashed form), and any other information you provide during registration.

2.3 Billing and Payment Data. If you subscribe to a Paid Plan, we collect payment information such as credit or debit card details, billing address, and transaction history. Payment processing is handled by third-party payment processors; we do not store full card numbers on our servers.

2.4 Usage Data. We automatically collect information about how you interact with the Service, including pages visited, features used, actions taken, timestamps, session duration, referring URLs, and click patterns.

2.5 Device and Technical Data. We collect device type, operating system, browser type and version, screen resolution, IP address, unique device identifiers, and language preferences.

2.6 Content and User-Generated Data. We process the Content you upload, store, or transmit through the Service, including any data processed by AI Features.

2.7 Communications Data. If you contact us, we collect the content of your communications, including emails, chat messages, and any attachments.

2.8 Cookies and Tracking Data. We collect data through cookies, pixels, and similar tracking technologies as described in Section 9.

3. How We Use Your Personal Data

3.1 We use your personal data for the following purposes:

  • (a) to provide, operate, maintain, and improve the Service, including processing your Content through AI Features;
  • (b) to create, manage, and authenticate your Account;
  • (c) to process payments, manage subscriptions, and send billing-related communications;
  • (d) to communicate with you, including responding to inquiries and providing customer support;
  • (e) to send marketing communications where you have consented or where permitted by law (you may opt out at any time);
  • (f) to analyse usage patterns, trends, and performance to improve the Service;
  • (g) to detect, prevent, and address fraud, abuse, security incidents, and technical issues;
  • (h) to enforce our Terms of Service and protect our legal rights;
  • (i) to comply with applicable laws, regulations, legal processes, and government requests; and
  • (j) to carry out any other purpose described to you at the time of collection.

4. Legal Bases for Processing (EU/EEA/UK Users)

4.1 If you are located in the EU, EEA, or United Kingdom, we process your personal data on the following legal bases under the GDPR:

  • (a) Performance of a Contract (Article 6(1)(b)): Processing necessary to provide the Service and fulfil our contractual obligations.
  • (b) Legitimate Interests (Article 6(1)(f)): Processing for improving the Service, ensuring security, preventing fraud, and conducting analytics.
  • (c) Consent (Article 6(1)(a)): Where you have given consent, such as for marketing communications or non-essential cookies.
  • (d) Legal Obligation (Article 6(1)(c)): Processing necessary to comply with legal obligations.

4.2 Where we rely on legitimate interests, we have conducted a balancing assessment to ensure our interests do not override your fundamental rights.

5. Sharing and Disclosure of Personal Data

5.1 We do not sell, rent, or trade your personal data. We do not share your personal data for cross-context behavioural advertising.

5.2 Service Providers. We share personal data with trusted third-party service providers who assist in operating the Service, bound by confidentiality and data protection obligations.

5.3 Legal Requirements. We may disclose personal data where required by law, regulation, legal process, or government request.

5.4 Business Transfers. In the event of a merger, acquisition, or sale of assets, your personal data may be transferred to the acquiring entity.

5.5 With Your Consent. We may share your personal data for any other purpose with your prior consent.

6. International Data Transfers

6.1 Your personal data may be transferred to, stored, and processed in countries other than your country of residence, including Sweden and other EU/EEA countries.

6.2 Where we transfer personal data outside the EU/EEA, we implement appropriate safeguards including Standard Contractual Clauses, adequacy decisions, or the EU-U.S. Data Privacy Framework.

7. Data Retention

7.1 We retain your personal data only for as long as necessary to fulfil the purposes for which it was collected.

7.2 Account data is retained for the duration of your Account and for 90 days after deletion.

7.3 Billing and transaction data is retained for the period required by applicable tax and accounting laws (typically 7 years in Sweden).

7.4 Usage and technical data is retained in identifiable form for up to 24 months and may be retained in anonymised form indefinitely.

7.5 Content is retained for the duration of your Account. Upon termination, Content is retained for up to 30 days, after which it is permanently deleted.

8. Data Security

8.1 We implement appropriate technical and organisational security measures including encryption of data in transit and at rest, access controls, regular security assessments, and employee training.

8.2 No method of transmission over the internet is completely secure. We cannot guarantee absolute security.

8.3 You are responsible for maintaining the confidentiality of your Account credentials. Please notify us at info@archerfutura.com if you suspect unauthorised access.

9. Cookies and Tracking Technologies

9.1 We use cookies and similar technologies to operate and improve the Service.

9.2 We use the following categories:

  • Strictly Necessary Cookies. Required for the Service to function. Cannot be disabled.
  • Functional Cookies. Enable enhanced functionality and personalisation.
  • Analytics and Performance Cookies. Help us understand how the Service is used.
  • Marketing Cookies. Used to deliver relevant advertising. Only placed with your consent where required.

9.3 You can manage cookie preferences through your browser settings or our cookie consent mechanism.

9.4 For EU/EEA and UK users, non-essential cookies are only placed with your prior consent.

10.1 Depending on your location, you may have the following rights:

  • (e) Right to Data Portability: receive your data in a structured, machine-readable format.
  • (f) Right to Object: object to processing based on legitimate interests or for direct marketing.

  • (h) Right to Lodge a Complaint: lodge a complaint with a supervisory authority. In Sweden: Integritetsskyddsmyndigheten (IMY).

11. Additional Rights for California Residents (CCPA/CPRA)

11.1 California residents have additional rights including the right to know, right to delete, right to correct, and right to opt out. We do not sell or share your personal information as defined under the CCPA/CPRA.

12. Additional Information for Canadian Users

12.1 For Canadian users, personal data is processed in accordance with PIPEDA and applicable provincial legislation.

13. Children's Privacy

13.1 The Service is not directed at children under 16 (or 13 in the United States). We do not knowingly collect data from children under these ages.

13.2 If we become aware of such collection, we will delete the data promptly.

13.3 If you believe we have inadvertently collected data from a child, contact us at info@archerfutura.com.

14. AI Features and Data Processing

14.1 The Service may include AI Features that process your Content and inputs to generate outputs.

14.2 We process this data solely to provide the AI Features to you and to maintain and improve the Service.

14.3 We do not use your Content to train or improve our AI models for general purposes without your explicit consent.

14.4 AI Output may be temporarily stored to deliver the Service. We do not retain it beyond the necessary period unless you save it.

14.5 You are responsible for reviewing AI Output and ensuring compliance with applicable data protection legislation.

15. Third-Party Links and Services

15.1 The Service may contain links to third-party websites or services not operated by us. This Policy does not apply to those services.

15.2 We are not responsible for the privacy practices of any third-party service.

16. Changes to This Privacy Policy

16.1 We may update this Policy from time to time. We will notify you of material changes at least 30 days before they take effect.

16.2 Your continued use of the Service after the effective date constitutes acceptance of the updated Policy.
